CalmJaw – Terms of ServiceLast updated: Sept 15, 2025These Terms of Service (“Terms”) govern your access to and use of the CalmJaw mobile application and website (the “Service”). The Service is operated by Julian DiVto, sole proprietor (“CalmJaw,” “we,” “us,” or “our”). By tapping “I accept” or using the Service, you agree to these Terms and our Privacy Policy.Important safety notice: If you are experiencing a medical or mental health emergency, call 911 or go to the nearest emergency department. Do not use CalmJaw for crisis situations.1. The Service1.1 Provision. During your subscription, we’ll use commercially reasonable efforts to provide access to CalmJaw and any related documentation.1.2 Personal use only. You may use the Service solely for your personal wellness.1.3 No exclusivity. Your rights are non-exclusive and revocable.2. Who shouldn’t use CalmJawDo not use the Service if:you need urgent medical attention;you are under 18 without parental/guardian consent; oryou have a history of severe psychiatric illness (including schizophrenia, psychosis, or comparable conditions) unless cleared by a licensed clinician.3. Important acknowledgementsYou agree and understand that:CalmJaw is not medical care and does not provide medical advice, diagnosis, or treatment.Content is for information and self-guided wellness only. Always follow advice from your licensed healthcare providers if it conflicts with anything in the app.Guided sessions may evoke strong emotions or physical sensations.You are responsible for ensuring your device, OS, and internet connection are compatible.(CalmJaw does not currently offer live coaching; if added later, it will not be medical care.)4. Your responsibilitiesYou must:use CalmJaw lawfully and only for personal wellness;stop using the Service and seek professional help if you experience distress;keep your login credentials secure and notify us of any compromise;not copy, reverse engineer, distribute, rent, sell, or make public any part of the Service or its content;not attempt to bypass security or create derivative works.5. Features and changesWe may add, modify, suspend, or remove features at any time.6. Third-party servicesThe Service may integrate with third-party apps or providers (e.g., app stores, cloud hosting). Access and support for those are between you and the third party. We are not responsible for third-party services.7. Accounts & securityWe may issue or enable credentials for access. You’re responsible for all activity under your account. We may change or revoke credentials to protect the Service.8. Support & updatesWe may release updates and may require you to install them. Unless stated otherwise, support is not guaranteed.9. Fees & payments9.1 Subscriptions. If CalmJaw offers paid subscriptions, fees are shown at purchase and charged via the app store you use (e.g., Apple App Store). Taxes may apply.9.2 Auto-renewal. Subscriptions auto-renew unless you turn off auto-renew in your app-store account at least 24 hours before the current term ends. Your account may be charged within 24 hours prior to renewal.9.3 Changes. We may change subscription pricing for future terms with prior notice. If you don’t agree, cancel before the next renewal.9.4 Refunds. Initial fees may be refundable only per our Refund Policy and/or your app store’s refund rules.If a payment fails, we may suspend access until paid.10. Unacceptable contentDo not upload content that is illegal, infringing, harmful, or contains malware. We may remove or disable access to such content.11. Suspension & terminationWe may suspend or terminate your access for maintenance, security reasons, non-payment, or breach of these Terms. You may cancel at any time; fees already paid are generally non-refundable unless required by law or our Refund Policy.Upon termination you must stop using the Service; we may disable access and delete stored data per our retention policies.12. Children’s informationThe Service is not directed to children under 15. If we learn we’ve collected personal information from a child under 15 without consent, we’ll delete it.13. Intellectual property & data13.1 Our IP. CalmJaw, its content, and all related intellectual property are owned by us or our licensors. We grant you a limited, revocable, non-transferable license to use the Service during your subscription.13.2 Your data. You grant us a license to use your data to operate and improve the Service, including de-identified analytics, as permitted by law and our Privacy Policy.13.3 Privacy. We collect, use, and disclose data per our Privacy Policy (available in-app under Settings → Privacy Policy). By using the Service, you consent to our processing of your data (which may include health-related information you choose to provide) as described there.14. Security, availability, and backupsWe take reasonable steps to protect data but cannot guarantee internet transmissions or the Service will be 100% secure or available. The Service may be unavailable at times (scheduled or unscheduled).15. Warranties & disclaimersTo the extent allowed by law, the Service is provided “as is” and “as available.” We do not warrant that it will be error-free, uninterrupted, or fit for a particular purpose, or that outcomes, reports, or content will be accurate or reliable.You acknowledge you selected the Service based on your own judgment and use it at your own risk.16. Liability limitsNothing in these Terms excludes liability that cannot be excluded under applicable consumer laws.To the maximum extent permitted by law:our total liability for all claims related to the Service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim; andwe are not liable for indirect, special, incidental, punitive, or consequential losses (including loss of profits, data, or goodwill).Any claim must be brought within 6 months after it arises.17. IndemnityYou will indemnify us from losses arising out of your breach of these Terms, your misuse of the Service, your content, or your violation of law or third-party rights.18. TaxesFees are exclusive of applicable Canadian taxes. You’re responsible for any required withholdings or additional amounts so we receive the full fees due.19. SubcontractorsWe may use subcontractors and service providers (e.g., cloud hosting) to operate the Service.20. Geographic access & complianceThe Service may be accessible from various jurisdictions. You’re responsible for compliance with local laws where you use the Service.21. Changes to these TermsWe may amend these Terms by providing at least 30 days’ prior notice (e.g., in-app or by email). 23. GeneralGoverning law. These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada, and disputes are subject to the courts of British Columbia.Assignment. You may not assign these Terms without our consent. We may assign at any time with notice.Entire agreement. These Terms and the Privacy Policy are the entire agreement for the Service.Force majeure. We’re not liable for delays or failures due to events beyond our reasonable control.Severability; waiver. If a provision is unenforceable, the rest remain in effect. A waiver must be in writing.Medical disclaimer (highlight)CalmJaw provides educational wellness content (e.g., guided audio for jaw and facial relaxation). It is not a substitute for professional medical advice, diagnosis, or treatment.
